The Creative Green Tools platform is hosted and maintained by our third party provider Julie's Bicycle who acts as our data processor and will handle helpdesk support on behalf of Impala.

By using our site you accept these terms of use. By using our site you confirm that you have the authority to bind the business on behalf of which you are accepting these terms of use. If you do not agree to these terms of use, you must not use our site.

TERMS OF USE

1. Accessing our site

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site, subject to any express agreement to the contrary.

Access to our site is restricted to users who have registered on our site. When you register for an account you must ensure that all the information you provide to us is accurate and kept up to date.

You must treat any piece of information as part of our security procedures including any user identification code, username or password as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at impalasupport@juliesbicycle.com

You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them. We do not guarantee that our site will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons.

You may use our site only for lawful purposes. You may not use our site:

  • In any way that breaches any applicable local, national or international law, regulation or infringes any third party rights.
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • For the purpose of harming or attempting to harm minors in any way.
  • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware. *To reverse engineer or otherwise attempt to derive or obtain information about the functioning, manufacture or operation of our site.

You also agree:

  • Not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of these terms.

Not to access without authority, interfere with, damage or disrupt:

  • any part of our site;
  • any equipment or network on which our site is stored;
  • any software used in the provision of our site; or
  • any equipment or network or software owned or used by any third party.

2. Intellectual property rights

We have a licence to use the intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

We provide you with a worldwide, non-exclusive, non-transferable, non-sublicensable, revocable limited term licence to use our site in accordance with these Terms.
You may print off, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified developers (Julie's Bicycle) and contributors) as the authors of material on our site must always be acknowledged.
You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

3. Reliance on information posted

We take reasonable care to ensure the accuracy of our site but we make no representation or warranty, express or implied, of the accuracy or completeness of the reports generated on the site and all of the reports are intended as a general overview only. We do not accept any liability for any action or inaction taken in reliance upon the reports or for any error or omission in relation to the content of the reports. You expressly agree that your use of, and your reliance upon, the reports is at your sole risk.

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:

Any liability whether in contract, tort or otherwise for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for:

  • loss of profits or contracts;
  • loss of anticipated savings;
  • loss of data;
  • loss of goodwill;
  • wasted management or office time;
  • Any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

You agree to indemnify us, our affiliates, directors, officers, employees and suppliers against all loss, costs, damages liabilities and expenses that arise out of your breach of these terms of use.

7. Information about you and your visits to our site

We process personal information about you in accordance with our privacy policy.

Will we share your data including personal data with our third-party provider Julie's Bicycle who will host and maintain our site, handle helpdesk support, and undertake collective analyses of data on behalf of us.

8. Inputting information to our site

In respect of all information that you input into our site, you grant to us a worldwide, irrevocable, non-exclusive, transferable, and royalty-free licence to use, reproduce, publish, translate and distribute such information in an anonymised format for research, educational and teaching purposes including the development and publication of industry and/or sector analysis and benchmarks, and to improve our site. If you are a member of a national association which is a member of IMPALA, you grant the same licence to the relevant national association.

You will ensure that you own or have otherwise obtained all necessary rights, consents, and permissions to share and upload your content to our site. We will not be responsible, or liable to any third party, for the content or accuracy of any information inputted by you or any other user of our site.

We have the right to remove any information you input to our site.

9. Viruses, hacking and other offences

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

We, IMPALA AISBL of Coudenberg, 70, 1000, Bruxelles, Belgium ("We") are committed to protecting and respecting your privacy. This policy (together with our terms of use and any other documents referred to on it) sets out the basis on which any personal and other data we collect from you through our site or that you provide to us through the Creative Green Tools and impalasupport@juliesbicycle.com address, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and other data and how we will treat it.

15. How we collect and use information from you when you use our site:

  • We collect information that you provide by filling in forms and data fields on our site https://impala.ig-tools.com/ or email at impalasupport@juliesbicycle.com . This includes information provided at the time of registering to use our site and when you contact us about our site, data inputted when using our carbon calculators, posting material and uploading files, or requesting further services. We may also ask you for additional information when you report a problem with our site.

  • We collect anonymised details of your visits to our site and the resources that you access.

16. We may collect and process the following personal data about you:

  • Your name, email address, job title, contact details and any other information you provide to us which could identify you.

17. We may use your personal data in the following ways:

  • To notify you about changes to our service. We do so based on our legitimate interests.
  • To contact you with any queries in relation to the environmental and organisational data you have submitted, and/or to provide support in relation to your use of our site. We do so based on our legitimate interests.
  • To create your account. We do so in order to perform the contract between us.

18. We may collect and process the following other data through the our site which is not personal data:

  • Information submitted by you through our site about your organisational environmental impact, which may include (but is not limited to) energy consumption, waste generated, travel and transport, water use.
  • Information submitted by you through the our site about your overall organisational profile, which may include (but is not limited to) FTE staff, floor area, building age, and more.
  • Any other information about your business practices, and your environmental policy and action plan, submitted through the Beyond Carbon and other comment fields on our site.

19. We may use this other data in the following ways:

  • To calculate carbon emissions resulting from inputted data.
  • For research, educational and teaching purposes including the development and publication of industry and/or sector analysis and benchmarks.
  • To ensure that content from our site is presented in the most effective manner for you and for your computer. We use statistical and anonymised data about our users’ browsing actions and patterns for system administration.

We understand that some of the above data may be considered business sensitive. We and our provider Julie’s Bicycle therefore commit not to share any of this data publicly except in aggregate, anonymised formats (such as sector reports or benchmarks) unless we have previously obtained your explicit written agreement.

Our site may, from time to time, contain links to and from the websites of partners and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

20. Where we store your information

The information that we collect from you may be transferred to, and stored at, a destination outside the UK or European Economic Area ("EEA"). It may also be processed by staff operating outside the UK or EEA who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the provision of support services, or the maintenance and update of our site. We will ensure that any such transfer of personal data complies with applicable data protection law.

Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

If you are a member of a national association that is part of IMPALA’s network, we will also share your organisation's name with that association, as well as with the task force advising IMPALA on sustainability issues, if you create an account on our site.

22. Retention

We will only retain your personal data for so long as is necessary for the purposes for which we collected it.

  • ask us to erase the personal data we hold about you;
  • ask us to restrict our handling of your personal data;
